This hire agreement is made between David M Gilbert t/as Your Local Tech Solutions, ABN: 76209131717 ("we", "us", "our") and the person hiring the equipment ("you", "the Hirer"). By booking and signing, you agree to the following terms.

1. The equipment

"Equipment" means the Starlink Mini satellite terminal and all accessories supplied for your hire (dish/terminal, power supply, cables, carry case and any other items listed at pickup). The Equipment remains the property of David M Gilbert t/as Your Local Tech Solutions, ABN: 76209131717 at all times.

2. Hire period

The hire runs for the dates confirmed in your booking. You must return the Equipment by the agreed return date and time. Late returns are charged at the daily hire rate (currently $30.00 per day) for each day or part-day late, deducted from your deposit or invoiced.

3. Fees, payment and security deposit

The hire fee is the amount for the option you select (daily, weekend or weekly). A refundable security deposit of $250.00 is payable before or at pickup. The deposit is held against loss, damage, excess-data charges and late fees, and is refunded in full within a reasonable time after the Equipment is returned complete and in good working condition.

4. Data allowance and excess usage

Each hire includes a fair-use data allowance: 5 GB per day for daily hire, 20 GB for a weekend hire, and 35 GB for a weekly hire. Data used above your allowance is charged at $2.20 per GB, deducted from your deposit or invoiced if it exceeds the deposit. Usage is measured via the Starlink account associated with the Equipment.

5. Your responsibilities

• Keep the Equipment secure and in your care for the whole hire period.
• Use the Equipment only for lawful purposes and in accordance with our setup instructions and Starlink's terms of service.
• Do not open, modify, repair, or tamper with the Equipment, or attempt to transfer the Starlink service to another account.
• Protect the Equipment from theft, misuse, weather beyond its rating, power surges and any avoidable damage.
• Do not sub-hire, lend or give the Equipment to anyone else.

6. Loss and damage

You are responsible for the Equipment while it is in your care. Lost, stolen or damaged items are charged at the published replacement/repair costs, deducted from your deposit or invoiced where they exceed it. You must tell us as soon as possible if the Equipment is lost, stolen or damaged.

7. Internet service and availability

Internet connectivity is provided over the Starlink satellite network and depends on coverage, obstructions, weather and network conditions at your location. We do not control that network and cannot guarantee speeds, coverage or uninterrupted service, and are not liable for service interruptions or their consequences.

8. Liability and Australian Consumer Law

Nothing in this agreement excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded. To the extent permitted by law, our liability for failure to comply with a consumer guarantee (other than in relation to goods or services of a kind ordinarily acquired for personal, domestic or household use) is limited to re-supplying the hire or paying the cost of doing so. To the extent permitted by law, we are not liable for any indirect or consequential loss (including loss of income, data or business) arising from your use of, or inability to use, the Equipment.

9. Cancellation

If you need to cancel or change your dates, please contact us as early as possible. We will do our best to accommodate changes subject to availability.

10. Privacy

We collect your details only to manage your hire and will handle them in accordance with our privacy practices. We will not sell your information.

11. Governing law

This agreement is governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.

12. Acceptance

By signing (typed name and drawn signature) at the time of booking, you confirm that you have read, understood and agree to this hire agreement with David M Gilbert t/as Your Local Tech Solutions, ABN: 76209131717.
